Bronx Lead Paint Compliance

LOCAL LAW REQUIREMENTS FOR NYC PROPERTY OWNERS
The Bronx includes many older apartment buildings and multifamily properties where lead-based paint compliance can be an important responsibility for owners and managing agents. New York City Local Law 1 applies to covered pre-1960 buildings and certain buildings constructed between 1960 and 1978 where the owner knows lead-based paint is present. Applicable responsibilities can include tenant notices, annual investigations, lead-safe work practices, turnover requirements, and recordkeeping.
Covered rental units and common areas were also required to undergo X-ray fluorescence (XRF) testing by August 9, 2025. Testing uses the current 0.5 mg/cm² lead-based paint threshold. Bronx property owners who have not completed required testing should address outstanding obligations and maintain the documentation needed to demonstrate compliance.

XRF Testing Requirements

Required XRF testing must be performed by an appropriately certified inspector or risk assessor. Testing documents which painted components meet the current lead-based paint threshold, providing records that property owners must retain.

Annual Compliance Duties

Local Law 1 requires ongoing action at covered properties, including annual notices and investigations when a child under six resides in a unit. When lead-based paint hazards are identified, owners must follow applicable lead-safe requirements.
